II Encuentro de jóvenes investigadores: Tecnología y sostenibilidad en el Derecho privado

Description

Within the framework of the European Green Deal and the Digital Strategy 2030, the European Union is promoting a dual ecological and digital transition aimed at transforming economic sectors based on sustainability, social justice, and technological innovation. This transformation, known as a just and digital transition, not only affects public regulation but also has an increasing impact on private law, particularly in areas such as contracting, civil liability, and consumer rights.

The course seeks to show whether and to what extent private law can influence and/or needs to adapt to new social and economic developments in an increasingly digital world.

Objectives

Promote innovative research by young scholars.

Disseminating research in innovative fields.

Establish a mentoring relationship between young researchers and senior researchers.

Consolidate scientific research networks on key issues for the advancement of Private Law.

Award a prize for the most original research by the Spanish Association of Comparative Law.

Methodology

The proposal is not based on a traditional lecture-style methodology, but rather introduces active and participatory forms of learning that constitute one of its main distinctive features. Although the course maintains the academic rigor characteristic of a scientific seminar, its methodological design goes beyond the classic model of keynote lectures and is structured around a deliberative and interactive format, organized as follows:

  1. Short presentations by early-career researchers (20 minutes).
  2. A structured critical commentary by a senior academic (discussant).
  3. An open debate with the audience following each presentation.
  4. Academic moderation to ensure thematic coherence and dynamic discussion.

This structure introduces several relevant innovations:

  1. Active audience participation, with formally allocated time for discussion after each presentation.
  2. Intergenerational interaction, combining emerging researchers and established scholars in a mentoring-oriented dynamic.
  3. A competitive selection process through a call for papers, ensuring thematic plurality, scientific quality, and openness to innovative approaches.
  4. Recognition of research excellence, through the award granted to the best paper presented.

She has relevant skills for research and educational proposals as shown by different National and European Projects, i. a, those that deepen legal knowledge on the building and development of European Private Law. Fellow of the German DAAD (2003), the Alexander von Humboldt Foundation (2006-2007) and the European Law Institute (2010), she has also been Visiting Scholar at different National, American, European and Asian Universities. She currently teaches European and Spanish private law at the U. Barcelona and also Spanish and European contract law for foreign lawyers at the U. Münster.

          Professor of Civil Law at the University of La Rioja since October 2007. He graduated (1991) and obtained his PhD with extraordinary prize in 1996 from the University of Navarra. Research stays in Germany (Freiburg, 1993, Munich, 1996) and visiting scholar at Oxford University (2003 and 2015). President of the ‘International Academy of Inheritance Law’ and vice-president of the ‘Spanish Association of Comparative Law’. Director of several research projects on digital law and consumer protection, with several publications on digital succession, as well as work on contract law, trusts, European and comparative private law and intellectual property. Member of several international networks: Comparative Succession Law Group [Max-Plank-Institute - Hamburg, 3 volumes at OUP, Oxford University Press], International Academy of Comparative Law (Paris), European Law Institute [Vienna], etc.; in the latter he has been advisor to the project on ‘Access to Digital Assets’, member of the ‘High Level Expert Group on Digital Succession’ (since 2022) and member of the Advisory Committee of the ELI draft Model Law on ‘Succession of Digital Assets, Data and other Digital Remains’.

          She holds a PhD in Law and is a lecturer in Civil Law at the UPV/EHU. Her main line of research is bioethics, a subject on which she has published several monographs and scientific and dissemination articles. She has participated in 4 European research projects of the VI and VII European Framework Programme, as well as in multiple research projects of the National Programme. She has been a visiting professor at the Hastings Center for Bioethics in New York, the Center for Bioethics at the University of Philadelphia and the University of Bordeaux. She was Secretary General of Eusko Ikaskuntza, and later of Jakiunde, Academy of Sciences, Arts and Letters. Vice-rector of quality and teaching innovation at the UPV/EHU between 2008 and 2012, and responsible for the development of the educational model, as well as quality programmes, and training and evaluation of university teaching staff. Between 2013 and 2015, she was Deputy Minister of Universities and Research of the Basque Government.

          Ha llevado a cabo una extensa trayectoria científica y académica en el ámbito del derecho mercantil que se demuestra a través de las numerosas y valiosas contribuciones realizadas en el campo del derecho mercantil, en materias tales como el derecho del transporte, el derecho del seguro, la competencia desleal y el derecho de sociedades y de las organizaciones del tercer sector publicadas en revistas jurídicas de gran prestigio científico. Como consecuencia de ello se le han reconocido cinco sexenios de investigación. Ha participado como ponente en numerosos congresos nacionales e internacionales en los que ha tenido la oportunidad de exponer los resultados de sus investigaciones. Debe destacarse también su labor como investigador principal en más de 10 proyectos de investigación competitivos y como director de 10 tesis doctorales cuyos autores obtuvieron la máxima calificación. Es árbitro de la Corte Arbitral de la Cámara de Gipuzkoa para resolver controversias jurídicas suscitadas entre empresas. Ha elaborado numerosos informes jurídicos en materia de derecho mercantil a requerimiento de empresas, particulares y administraciones públicas. En estos momentos también es of counsel en el despacho de abogados LKS Next Legal.

          Raquel Guimaraes

          Prof. Dr Maria Raquel de Almeida Graça Silva Guimaraes: PhD (2010) in Civil Law from the University of Porto, Portugal. Master’s degree in Banking and Corporate Law from the University of Coimbra (1998) and Postgraduate Diploma in Banking Law from the University of Salamanca (2002). Full Professor of Civil Law at the University of Porto (Portugal). Researcher at the CIJ and Editor-in-Chief of the RED Electronic Law Journal. Supervisor of three doctoral theses currently in progress on issues related to digital law. Her research interests include: contract law, consumer law, electronic payment methods, e-commerce, privacy, digital law and data protection.           Prof. Dr Christian Twigg-Flesner: Professor of Contract and Consumer Law, University of Warwick (United Kingdom). Editor-in-chief of the Journal of Consumer Policy, Member of the European Law Institute (ELI) (member of its Council from 2019 to 2023) and of the Innovation and Technology Law Laboratory. His main areas of research focus on contract law, commercial law and consumer law, covering English, European and international aspects. His current research focuses on the impact of digitalisation in these fields. Researcher and legal adviser on international European projects on “Guiding principles and model rules on algorithmic consumer contracts”, “Smart technology and consumer protection” and, currently, with Prof. Busch, on digital subscriptions.
